Privacy notice

This notice explains which personal data we process when you use the site, write to us or become one of our guests or owners, why we do it and what rights you have. It covers the lamodernaservizi.com site, WhatsApp conversations and the requests that reach us through property portals.

1. Who processes your data

The data controller is La Moderna Servizi & Property Management S.R.L., Via Guglielmo Marconi 56, 24035 Curno (BG), Italy, VAT no. 04777410160. Email: info@lamodernaservizi.com.

For any question about your data you can write to the same email address.

2. Which data we process

  • Data you give us in the site's forms: name, surname, phone, email, language; for people looking for a home also dates, length of stay, budget, type of home, number and type of occupants, pets, occupation and particular needs; for owners the area, type, size and condition of the property.
  • Messages you send us on WhatsApp or by email, and the requests property portals (Idealista, Immobiliare.it, Casa.it) forward to us when you reply to one of our listings.
  • Data needed for a contract, if you sign one with us: ID document, tax code, address, payment details.
  • Technical data of the visit in which you send a form: landing page, referring site and advertising campaign parameters (UTM), browser type. We do not store your IP address in clear: we keep a non-reversible fingerprint, only to block spam submissions.

Anonymous, aggregated visit statistics (pages viewed, referring site, device and browser type, country, page speed) through Vercel Web Analytics and Vercel Speed Insights: they use no cookies, store nothing on your device and do not recognise you from one visit to the next.

The site does not use cookies: see the cookie policy.

3. Why we process them and on what basis

  • Answering your requests, suggesting suitable homes or valuing your property: pre-contractual steps taken at your request (Art. 6(1)(b) GDPR).
  • Signing and managing rental, management and related service contracts: performance of a contract (Art. 6(1)(b)) and legal obligations, such as tax and contract registration duties (Art. 6(1)(c)).
  • Prioritising requests with a score calculated from fixed rules (for example urgency, contract type, budget compared to the type of home): our legitimate interest in organising our work (Art. 6(1)(f)). The score decides nothing: who can rent a home is always decided by a person on our team.
  • Understanding where requests come from (site, campaigns, portals), with aggregated statistics: legitimate interest (Art. 6(1)(f)).
  • Protecting the site and forms from abuse: legitimate interest (Art. 6(1)(f)).
  • Measuring, anonymously and in aggregate, how the site is used and how fast it is, to improve it: legitimate interest (Art. 6(1)(f)).
  • Occasionally sending you offers and news: only with your consent (Art. 6(1)(a)), which you can withdraw at any time.

The required fields in our forms are needed to answer you: without them we cannot follow up on your request. Consent to promotional messages is always optional.

4. Artificial intelligence and Aurora

In the site chat and on WhatsApp you may also be answered by Aurora, a virtual assistant based on artificial intelligence, together with our team. Aurora says so when the site chat opens and in her first reply on WhatsApp; if you write "operator", the conversation passes to a person.

In the site chat Aurora does not ask for personal data: to be contacted, she offers you the form or WhatsApp. If you type an email address or a phone number, we remove it from the message before saving it and before passing it to the model. If you continue on WhatsApp with the chat reference (for example "site ref. K7Q2MX"), Aurora finds the site conversation, so you don't have to repeat yourself.

We also use artificial intelligence to read portal emails and prepare the request record, and to write a short note for our staff about what you are looking for and what is missing. Your contact details are not sent for that note.

We do not take decisions based solely on automated processing that produce legal effects or similarly significantly affect you (Art. 22 GDPR): every proposal, viewing or contract goes through a person on our team.

We use artificial intelligence models through OpenRouter, restricted to providers based in the United States or the European Union, with no data retention and no use of your data to train the models.

5. Who we share data with

  • The members of our team authorised to process them.
  • Providers processing data on our behalf, appointed as processors: Vercel (hosting of the site and CRM), Supabase (database), Twilio and Meta (WhatsApp), Google (email and calendar), OpenRouter and the permitted model providers (artificial intelligence), Telegram (internal team alerts), Cal.com (appointments).
  • The owner of the property, when needed to sign the contract, and the professionals who assist us (accountants, legal advisers).
  • Public authorities, when required by law (for example the Italian Revenue Agency for contract registration).

Property portals you write to us from process your data as independent controllers, under their own privacy notices. We never sell your data.

6. Transfers outside the European Union

Some providers are based in the United States. Transfers rely on the European Commission's adequacy decision (EU-US Data Privacy Framework) for certified providers, or on the standard contractual clauses approved by the Commission.

7. How long we keep them

  • Requests that do not become a contract: 24 months from the last contact.
  • Conversations with Aurora and the team, on WhatsApp and in the site chat: 24 months from the last message, unless needed for a current contract.
  • Contracts, accounting and tax documents: 10 years from the end of the relationship, as required by law.
  • Consent to promotional messages: until you withdraw it; we keep the consent log as evidence for the period required by law.
  • IP fingerprint and the site's submission log: 12 months.

8. Your rights

At any time you can ask us to:

  • access your data and receive a copy (Art. 15);
  • correct or complete them (Art. 16);
  • erase them (Art. 17) or restrict their processing (Art. 18);
  • receive them in a machine-readable format to take them elsewhere (Art. 20);
  • object to processing based on legitimate interest, and in any case to promotional messages (Art. 21);
  • withdraw your consent, without affecting the lawfulness of what was done before.

Just write to info@lamodernaservizi.com. We reply within one month. You can also lodge a complaint with the Italian Data Protection Authority (garanteprivacy.it).

9. Changes

We may update this notice. The date of the latest version is at the top of the page; if something important changes we will also say so on the site.
